1. Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of the Datascience Impact Hub website at datasciencehub.org and any related content, programs, or services (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
2. About us
The Services are operated by Datascience Impact Hub ("DIH", "we", "us"), a research and training organization established in Kenya with activities across Africa and Europe. You can contact us at info@datascience.co.ke.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
4. Permitted use
You may use the Services for lawful, non-commercial informational purposes. You agree not to:
- Use the Services in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Services, accounts, or networks.
- Interfere with, disrupt, or impose an unreasonable load on the Services.
- Use automated means (bots, scrapers) to access the Services without our prior written consent.
- Use the Services to transmit unlawful, harmful, defamatory, infringing, or otherwise objectionable content.
- Reproduce, distribute, or create derivative works of our content except as expressly permitted.
5. Intellectual property
All content on the Services — including text, graphics, logos, images, research publications, course materials, and software — is owned by Datascience Impact Hub or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable licence to access and view the content for personal, non-commercial use.
Where research outputs are released under an open licence (for example Creative Commons), the terms of that licence govern your use of those outputs. Our name and logo may not be used without our prior written permission.
6. Programs, courses, and registrations
Specific programs, certifications, and events may have additional terms — including fees, eligibility criteria, attendance requirements, and cancellation policies — which will be communicated at the point of registration and form part of your agreement with us.
7. User submissions
If you submit ideas, feedback, applications, or other content to us, you grant Datascience Impact Hub a non-exclusive, worldwide, royalty-free licence to use, reproduce, and adapt that content for the purpose of operating, evaluating, and improving the Services and our programs, subject to our Privacy Policy. You represent that you have the right to grant this licence.
8. Third-party links and services
The Services may contain links to third-party websites or resources we do not control. We are not responsible for the content, accuracy, or practices of those third parties, and accessing them is at your own risk.
9. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimers
The Services and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Information published on the Services is for general informational and educational purposes only and does not constitute professional, legal, financial, or technical advice.
11. Limitation of liability
To the maximum extent permitted by applicable law, Datascience Impact Hub and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars (USD 100). Nothing in these Terms limits liability that cannot lawfully be limited, including liability for gross negligence, wilful misconduct, or under mandatory consumer-protection law.
12. Indemnity
You agree to indemnify and hold Datascience Impact Hub harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Services.
13. Suspension and termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.
14. Changes to the Services and these Terms
We may modify or discontinue the Services, or update these Terms, from time to time. Material changes will be indicated by updating the "Last updated" date at the top of this page and, where appropriate, by additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-laws principles. The courts of Nairobi, Kenya have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory law in your country of residence (including EU consumer-protection law) grants you the right to bring proceedings in your local courts.
